This document constitutes the “Privacy Notice” of Alimentos Saludables Valle, S. de R.L. de C.V. hereinafter “ASV”.

Based on articles 8, 15, 16, 18 and 36 of the Federal Law on the Protection of Personal Data Held by Private Parties, we inform you that “ASV” has its registered address at Vía Jorge Jiménez Cantú # 20 Col. Plazas de Condado, Atizapán de Zaragoza, Edo. México, C.P. 52930 and is responsible for collecting your personal data, the use that is given to it and its protection.

The privacy of the information of the Holders is very important for “ASV”, that is why the maximum precautions are taken for the protection of personal data, in this sense, we use quality computer security mechanisms to guarantee the protection of the information in the most complete and effective way.

Purpose

This Privacy Notice regulates and regulates the manner, terms and conditions under which “ASV”, including its subsidiaries and related companies, are authorized and empowered by the Owner to obtain, process and transfer the Owner’s personal data; it describes the information that “ASV” obtains from its clients, suppliers, prospective employees and online users, as well as the handling and processing to which the personal data for which “ASV” is responsible are subject, and that the Owner of the Personal Data grants his/her consent for “ASV” to use his/her personal information in accordance with the policies described below:

Information that we collect.

“ASV” collects various information, with the main purpose of fulfilling the purposes of its corporate purpose, in this sense the data collected are:

1. Hiring of personnel (job prospects) and workers:

Due to the characteristics of the service provided and the nature of their work in which access to the interior of the client’s facilities is available, the following information is collected: Name and surname, marital status, Federal Taxpayer Registry, CURP, Mexican Social Security Institute affiliation number, Retirement Savings Fund Administrator, Proof of Address, Mexican Military Service Card Number, photographs of the job applicant’s address, declaration of: (i) no chronic diseases (ii) Work accidents (iii) Family Illnesses, Family Data: (i) Parents’ name and age (ii) Highest level of education (iii) Data from the medical service that assists them (iv) Occupation and place of work of the parents (v) Number of children, full name of children, ages and sex (vi) Bank account number, Personal references (i) Full name, Home phone number of the reference (ii) Address (iii) Years of knowing him/her (iv) Relationship.

1. Clients, prospective clients, suppliers and online users.

Full name of the individual or legal entity, Nationality, RFC, valid identification or document number, landline and cell phone number, address, email address, signature, financial information: bank account number and name of the bank; and passwords for electronic equipment.

“ASV” or its affiliates for the improvement of our services will make telephone or telemarketing calls, send requests by email, information on seminars, conferences or events.

The information that “ASV” obtains in all cases will be treated confidentially. The Owner will voluntarily provide his/her data, whether in writing, verbally, electronically, through surveys, by sending electronic files or of any other nature, including, but not limited to, direct delivery of information,

If users send “ASV” correspondence, whether emails or letters, or if other users or third parties send “ASV” correspondence about the activities or messages of other users on our site, we may collect and store such Personal Information, including email addresses.

Purpose and use of your data

The data previously collected is for the purpose of compliance derived from the contractual relationships to which “ASV” has committed itself. The data is illustrative but not limited as long as it is directly related to the provision of the service or the fulfillment of the corporate purpose.

We use your personal data for the purposes of registering in the internal system for clients and suppliers of “ASV”, managing payments, benefits, insurance, statistical information, internal processing data, commercial promotions, marketing studies, job and commercial offers, sale of products or services, surveys, advertising or similar matters, information on commercial or consumer preferences, income ranges, educational ranges, age ranges and/or socioeconomic level ranges.

Likewise, with the processing of your data, we carry out some or all of the fundamental activities related to the fulfillment of the obligations that arise from the contractual and/or commercial relationships that originate and/or derive from the provision of services, such as billing, quoting, entering into contracts, prospecting internal processing data, commercial promotions, marketing studies, commercial offers, providing the products you have requested, informing you about changes to them and evaluating the quality of the service we provide, we develop internal studies on the interests, behaviors and demographics of users to better understand their needs and interests and offer better services or provide them with related information.

We send information or messages by email about new services, display advertising or promotions, banners of interest to our users, news about “ASV”, in addition to the information expressly authorized.

We share Personal information (including email address) with service providers or “outsourcing” companies that contribute to improving or facilitating operations through “ASV”, such as: a) Transportation services; b) Payment methods, insurance or intermediaries in payment management; c) Call centers.

In this regard, it is mentioned that if the user and/or owner prefers, he/she may request to be excluded from the lists for sending promotional or advertising information.

“ASV” will ensure that certain standards of personal data protection are met, with the provider(s) hired by “ASV” to fulfill its objectives and contractual obligations, by signing agreements or conventions whose object is the privacy of the personal data of our users. However, “ASV” is not responsible for the improper use of the user’s Personal Information by these companies or Internet sites. If “ASV” decides to reveal or share Personal Information with third parties that are not service providers or companies affiliated or related to “ASV”, we will require your consent.

Confidentiality of Information

“ASV” will not sell, rent or share Personal Information except in the ways established in these policies, and in this regard we will do everything in our power to protect the privacy of the information. It may happen that by virtue of court orders, or legal regulations, “ASV” undertakes to reveal information to authorities or third parties under certain circumstances, or in cases where third parties may intercept or access certain information or data transmissions in which case “ASV” will not be responsible for the information that is revealed.

Excluded Data

The “ASV” website may include links to third party websites. If you access such links, you will leave the “ASV” website, for which reason, it does not assume any responsibility in relation to those third party websites. If you post, comment on or share personal information, including photographs, on any public forum, social network, blog or other such forum, you should be aware that any personal information you post can be read, viewed, collected or used by other users of such forums, and could be used to contact you or send you unsolicited messages for purposes that neither you nor “ASV” can control.

As a result, “ASV” is not responsible for any personal information you choose to submit to these forums or social networks.

“Cookies”

The user, client, owner and/or visitor of the “ASV” website knows and accepts that “ASV” may use a tracking system through the use of cookies (hereinafter “Cookies”).

“Cookies” are small files that are installed on the hard drive, with a limited duration in time, which help to personalize the services.

We also offer certain functionalities that are only available through the use of “Cookies”.

“Cookies” are used in order to know the interests, behavior and demographics of those who visit or are users of our Website and in this way, better understand their needs and interests and give them a better service or provide them with related information.

We will also use the information obtained through “Cookies” to analyze the pages browsed by the visitor or user, the searches performed, improve our commercial and promotional initiatives, display advertising or promotions, banners of interest, news about “ASV”, improve our offer of content and articles, personalize said content, presentation and services; we may also use “Cookies” to promote and enforce the rules and security of the site. “ASV” may add “Cookies” to the emails it sends to measure the effectiveness of the promotions.

We also use “Cookies” so that the user does not have to enter their password so frequently during a browsing session, also to count and corroborate registrations, user activity and other concepts for the “ASV” Program and other commercial agreements, always having as the objective of the installation of the “Cookies”, the benefit of the user who receives it, and will not be used for other purposes other than “ASV”.

Rights to access, cancel, rectify and oppose personal information (ARCO Rights)

Users and/or owners may exercise the rights to access, cancel, rectify and update their Personal Information, as well as to oppose the processing of the same, all in accordance with the provisions of the applicable regulations.

The owners guarantee and respond, in any case, for the veracity, accuracy, validity and authenticity of the Personal Information provided, and undertake to keep it duly updated. At any time, the owner, user, employee, client and supplier will have the right to request “ASV” to exercise the rights conferred by law, as well as the revocation of their consent by sending the corresponding request in writing to the following email address:

protecciondedatos@deorno.com in accordance with the “Form for the Exercise of ARCO Rights and Revocation of Consent” or, failing that, the format sent by the owner to their preference, as long as it contains the legal requirements.

It is understood that in order for “ASV” to be able to correctly and promptly respond to any of the requests referred to in this section, the request from the owner must prove his or her identity according to the information specified in the “Form for the Exercise of ARCO Rights and Revocation of Consent”.

The user and/or owner of personal data acknowledges and accepts that one of the purposes of the processing of his or her personal data is to comply with his or her contractual and/or commercial obligations that he or she maintains and/or will maintain with “ASV”, and therefore may not cancel and/or oppose the processing of personal data that may and/or could affect and/or restrict compliance with the same.

“ASV” through its personal data department will respond to your request for your ARCO Rights and the reasons for its decision by email within 20 business days, counted from the day the owner’s request was received. In the event that the request for ARCO rights is answered affirmatively or appropriately, the requested changes will be made within a maximum period of 15 business days. “ASV” may notify you within the aforementioned periods of the extension of the same, for one time only, for a period equal to the original.

“ASV” may deny access (“THE REFUSAL”) for the holder to exercise his ARCO rights, in the cases permitted by law, for which reason it must inform the holder of the reason for such decision.

The exercise of ARCO rights will be free of charge, but if the holder reiterates his request in a period of less than twelve months, the costs will be three months of the General Minimum Wage in Force in the Federal District, plus VAT, unless there are substantial modifications to the Privacy Notice, which motivate new ARCO requests. The holder must cover the justified shipping costs or the cost of reproduction in copies or other formats and, where applicable, the cost of certification of certain documents.

Modifications to the privacy notice

“ASV” may modify at any time the terms and conditions contained in the Privacy Notice and/or Privacy and Confidentiality Policies and/or email sending practices. If “ASV” decides to introduce any material changes, we will notify you by publishing an updated version in this section, by sending an email or informing you on the main page or other sections of the site to keep you updated of the changes made.

If “ASV” makes material changes in the way your Personal Information is managed, we will notify you by email so that you can make an informed decision as to whether or not you accept that your Personal Information be used in that way. If you do not accept these terms, your Personal Information will not be used in any way other than that which was informed to you at the time of collection.

Data storage.

Once the data is received, it will be processed and stored in a database that may be managed by “ASV” or by a third party (inside or outside the country where the Data was provided) with which “ASV” has a contract for such purposes.

“ASV” will incorporate protection mechanisms in order to avoid “as far as possible” deviations, adulteration, loss, consultation or unauthorized treatment of the Data.

Data Transfer

The Data may be transferred, stored and processed in the national country or in a country other than where it was provided, in which case “ASV” will transfer the information in accordance with the applicable information protection law.

The Owner understands and accepts that “ASV” is authorized to use, store, disclose and transfer the data. In this case “ASV” will enter into contracts with the third parties to whom it provides the data, in which the restrictions and other terms and conditions of this Privacy Notice will be incorporated.

“ASV” may also provide some of the data to suppliers of goods or services that require to know this information. These suppliers include, but are not limited to, credit card processors, marketing campaign providers, customer service and real-time support providers, email service providers and automated data processors. These service providers are contractually required to maintain the confidentiality of the data in accordance with this Privacy Notice.

If you do not express your opposition to your data being transferred, it will be understood that you have given your consent to do so. In this regard, the owner will have to communicate to us through the mechanisms that we have implemented the No consent to transfer your personal data in the terms indicated in this privacy notice.
